Under the jurisdiction of Bill 99 policies, and procedures as set out by WSIB, the board will extend the offer of mediation services where there exists certain “obstacles” present in an employers efforts to coordinate a Return To Work program.

Why Mediate?

From an employers perspective, the process of mediation represents a vital link to ensuring a safe and successful return to work plan. Quite often in any return to work efforts ( especially ones where the focus is “self – reliance” between the workplace parties ) conflicts are sure to arise.

Conflicting issues which may involve duties being performed, hours of work, wages, etc may act as a detriment to the return to work efforts of you, the employer.

A neutral third party, in this case the WSIB mediator can be requested and called upon to help facilitate the workplace parties in resolving issues related to a return to work. To you, the employer this will SIGNIFICANTLY reduce the number of cases which could otherwise be tied up in WSIB appeals where your staff member is then viewed as a “non producer” to the return to work process.

In light of WSIB’s policies and procedures surrounding Bill 99 where “self reliance” between the workplace parties is understood it is crucial for you, the employer to make use of the efforts to mediate where applicable. Given the in depth knowledge of our staff we will ensure that the “interests” of your company are made explicit during any mediation setting.
